Welcome to Daily.Hodgepodge ("Daily.Hodgepodge," "we," "us," or "our"). These Terms of Service ("Terms") are a binding legal agreement between you and Daily.Hodgepodge governing your access to and use of our website, online store, products (including the Mini Highland Cow Vet Box and any other physical or digital goods), subscriptions, printable downloads, email communications, and any related services (collectively, the "Services"). By accessing the Services, placing an order, or creating an account, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility & Children
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from us or enter into these Terms. Our products are designed for children ages 3 and up under adult supervision; however, only an adult may purchase, register an account, or transact with us. We do not knowingly collect personal information directly from children under 13. See our Privacy Policy.
2. Products, Descriptions & Availability
We make reasonable efforts to describe and photograph our products accurately. Because each kit is hand-curated, exact contents, colors, fabrics, and accessories may vary slightly from photos. Plush characters, cards, and accessories are subject to change based on availability. All products are offered subject to availability and may be limited, discontinued, or substituted at our discretion. Pricing and promotions may change at any time without notice.
3. Safety, Choking Hazards & Adult Supervision
Our boxes may contain small parts, miniature vet tools, fake props (e.g., faux mud, faux burrs, gauze), strings, and other components that may pose a choking, strangulation, or ingestion hazard. They are not suitable for children under 3 and must be used with active adult supervision. Faux mud and similar props are non-edible. Do not place items in mouth, ears, or eyes. Discontinue use of any damaged or worn item. By purchasing, you acknowledge these risks and agree to supervise use accordingly.
4. Orders, Payment & Taxes
All orders are offers to purchase, which we may accept or decline at our discretion (including for suspected fraud, pricing errors, stock issues, or shipping restrictions). Prices are listed in U.S. Dollars unless stated. You authorize us and our payment processors to charge your chosen payment method for the order total, including applicable taxes, shipping, and add-ons (such as gift wrapping). You are responsible for any duties, VAT, or import fees for international orders.
5. Shipping, Risk of Loss & Delivery
Shipping times are estimates, not guarantees. Risk of loss and title pass to you upon our delivery to the carrier. We are not liable for carrier delays, lost or stolen packages once marked delivered, or incorrect addresses provided at checkout. Please inspect your order on arrival and contact us within 7 days of delivery regarding damaged or missing items.
6. Returns, Refunds & Exchanges
Due to the hygienic, hand-curated, and play-based nature of our products, all sales are final unless the product arrives damaged, defective, or materially different from its description. If so, contact us within 7 days of delivery with photos and your order number, and we will arrange a replacement, store credit, or refund at our discretion. Personalized, gift-wrapped, refill, or clearance items are non-refundable except where required by law.
7. Subscriptions & Mission Club
If you enroll in a recurring plan (e.g., the Mission Club), you authorize us to automatically charge your payment method for each billing cycle at the then-current price until you cancel. You may cancel at any time before the next billing date via your account or by emailing us; cancellation stops future charges but does not refund the current cycle. We may modify pricing or features upon reasonable notice. Boxes already shipped or in production cannot be cancelled.
8. Gift Cards & Promotions
Gift cards and promo codes have no cash value, cannot be replaced if lost, and may not be combined with other offers unless stated. We reserve the right to cancel codes obtained fraudulently or in violation of these Terms.
9. Intellectual Property
All content on the Services — including the Daily.Hodgepodge name, logos, the Mini Highland Cow characters, illustrations, situation cards, printable checklists, photographs, copy, and digital downloads — is owned by or licensed to Daily.Hodgepodge and protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services and any digital downloads for personal, non-commercial use only. You may not reproduce, resell, redistribute, scrape, train AI models on, or create derivative works from our content without written permission.
10. User Accounts & Conduct
You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree not to: (a) misuse the Services or interfere with their operation; (b) attempt unauthorized access; (c) upload malicious code; (d) infringe any rights; (e) use the Services for unlawful purposes; (f) impersonate any person; or (g) use automated means (bots, scrapers) without our written consent.
11. User Submissions (Reviews, Photos, Tags)
If you submit reviews, photos, videos, testimonials, or tag us on social media ("Submissions"), you grant Daily.Hodgepodge a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display the Submissions for marketing and operating the Services, with attribution where reasonable. You represent that you own all rights to the Submissions, have consent from any identifiable person (including the parent or guardian of any child shown), and that the Submissions do not violate any law or third-party right.
12. Third-Party Services & Links
The Services may integrate third-party providers (payments, shipping, email, analytics) and link to third-party websites. We are not responsible for their content, policies, or practices. Your dealings with them are solely between you and the third party.
13. Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY.HODGEPODGE, ITS OWNERS, EMPLOYEES, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Daily.Hodgepodge and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services or products; (b) your violation of these Terms; (c) your Submissions; or (d) your violation of any law or third-party right, including failure to supervise a child during product use.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State in which Daily.Hodgepodge is principally based, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction there. Where permitted, you and we agree to first attempt informal resolution by contacting us at the email below for at least 30 days before initiating any formal proceeding.
17. Class Action Waiver
To the extent permitted by law, you and Daily.Hodgepodge agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative action.
18. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date will reflect the most recent version. Material changes will be communicated through the Services or by email. Continued use after changes constitutes acceptance.
19. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive (IP, disclaimers, liability, indemnity, dispute resolution) will survive termination.
20. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign freely. Headings are for convenience only.
